BASES Y CONDICIONES DEL SERVICIO DE ORIENTACIÓN JURÍDICA PRO BONO PARA PERSONAS DAMNIFICADAS

1. Objeto del servicio

El Ilustre Colegio de la Abogacía de Almería pone a disposición de las personas damnificadas por los incendios de Los Gallardos, Bédar y Antas un servicio de orientación jurídica inicial, prestado gratuitamente por profesionales de la Abogacía inscritos voluntariamente en el turno pro bono creado para esta finalidad.

El objetivo del servicio es ofrecer una primera valoración jurídica de las consultas relacionadas directamente con los daños o consecuencias derivados de los incendios.

2. Personas destinatarias

Podrán solicitar el servicio las personas físicas que hayan resultado directamente afectadas por los incendios indicados.

3. Contenido de la consulta gratuita

El servicio comprende una consulta jurídica inicial gratuita, en la que el profesional asignado podrá:

  • Informar sobre los derechos, posibles actuaciones y vías de reclamación.
  • Informar, cuando proceda, sobre la posibilidad de solicitar asistencia jurídica gratuita.

4. Carácter gratuito y ausencia de contratación posterior

La consulta inicial será completamente gratuita para la persona solicitante.

El profesional asignado no podrá exigir honorarios, contraprestaciones o pagos por la atención prestada dentro de este programa, ni utilizar el servicio para captar o derivar clientela.

5. Confidencialidad y secreto profesional

La información, documentación y comunicaciones conocidas por el profesional durante la consulta estarán protegidas por el deber de confidencialidad y secreto profesional.

El secreto profesional comprende los hechos, comunicaciones, datos, documentos y propuestas conocidos o recibidos en el ejercicio profesional, y continuará vigente después de finalizar la atención.

6. Protección de datos personales

Responsable del tratamiento: ILUSTRE COLEGIO DE LA ABOGACÍA DE ALMERÍA — Q0463001H — dpd@icaalmeria.com.

Finalidades: tramitar la solicitud, comprobar el cumplimiento de los requisitos, asignar un profesional, concertar la consulta, realizar el seguimiento administrativo del servicio y atender posibles incidencias o reclamaciones.

Base jurídica: el consentimiento de la persona solicitante y la adopción de las medidas necesarias para atender el servicio expresamente solicitado.

Los datos estrictamente necesarios serán comunicados al profesional asignado. También podrán comunicarse a proveedores tecnológicos que actúen por cuenta del responsable y, cuando exista una obligación legal, a las autoridades u organismos competentes.

Cuando la consulta incluya datos especialmente protegidos —por ejemplo, información médica, discapacidad u otras circunstancias personales sensibles— se solicitará, cuando resulte necesario, el consentimiento expreso para tratarlos.

Los datos se conservarán durante el tiempo necesario para gestionar la consulta y, posteriormente, durante los plazos exigidos para atender posibles responsabilidades legales o deontológicas.

La persona interesada podrá ejercer sus derechos de acceso, rectificación, supresión, oposición, limitación y portabilidad dirigiéndose a dpd@icaalmeria.com, y podrá presentar una reclamación ante la Agencia Española de Protección de Datos.

La información deberá ofrecerse de manera clara antes de recoger los datos personales, conforme al Reglamento General de Protección de Datos y a la Ley Orgánica 3/2018.

7. Aceptación

La presentación de la solicitud implica que la persona interesada declara:

  • Haber leído y comprendido estas bases.
  • Solicitar voluntariamente la consulta jurídica inicial gratuita.
  • Autorizar que sus datos sean comunicados al profesional que resulte asignado.
  • Conocer que la solicitud no suspende ni interrumpe ningún plazo.
  • Comprender que la consulta no incluye la defensa judicial ni la realización de actuaciones posteriores.
  • Comprometerse a facilitar información veraz y suficiente.

TERMS AND CONDITIONS OF THE PRO BONO LEGAL GUIDANCE SERVICE FOR AFFECTED PERSONS

1. Purpose of the service

The Ilustre Colegio de la Abogacía de Almería —the Almería Bar Association— offers persons affected by the fires in Los Gallardos, Bédar and Antas an initial legal guidance service, provided free of charge by legal professionals who have voluntarily joined the pro bono panel created for this purpose.

The purpose of the service is to provide an initial legal assessment of enquiries directly related to the damage or consequences arising from the fires.

2. Eligible persons

The service may be requested by individuals who have been directly affected by the aforementioned fires.

3. Scope of the free consultation

The service includes one free initial legal consultation, during which the assigned legal professional may:

  • Provide information about the applicant’s rights, possible courses of action and available avenues for making a claim.
  • Provide information, where appropriate, about the possibility of applying for legal aid.

4. Free nature of the service and absence of subsequent engagement

The initial consultation will be completely free of charge for the applicant.

The assigned legal professional may not request fees, compensation or payment for assistance provided under this programme, nor use the service to solicit or refer clients.

5. Confidentiality and professional secrecy

All information, documents and communications disclosed to or obtained by the legal professional during the consultation will be protected by the duties of confidentiality and professional secrecy.

Professional secrecy covers all facts, communications, data, documents and proposals known or received in the course of professional practice and will remain in force after the assistance has ended.

6. Protection of personal data

Purposes: to process the application, verify compliance with the eligibility requirements, assign a legal professional, arrange the consultation, carry out the administrative monitoring of the service and deal with any incidents or complaints.

Legal basis: the applicant’s consent and the taking of the measures necessary to provide the service expressly requested.

The strictly necessary data will be disclosed to the assigned legal professional. Data may also be disclosed to technology providers acting on behalf of the data controller and, where there is a legal obligation, to the competent authorities or bodies.

Where the enquiry includes special categories of personal data —for example, medical information, disability data or other sensitive personal circumstances— explicit consent to process such data will be requested whenever necessary.

The data will be retained for the time required to manage the consultation and subsequently for the periods necessary to address any possible legal or professional responsibilities.

The data subject may exercise the rights of access, rectification, erasure, objection, restriction of processing and data portability by contacting dpd@icaalmeria.com. The data subject may also lodge a complaint with the Spanish Data Protection Agency.

This information must be provided clearly before personal data are collected, in accordance with the General Data Protection Regulation and Spanish Organic Law 3/2018.

7. Acceptance

By submitting the application, the applicant declares that they:

  • Have read and understood these terms and conditions.
  • Voluntarily request the free initial legal consultation.
  • Authorise their data to be disclosed to the legal professional assigned to their case.
  • Understand that submitting the application does not suspend or interrupt any legal, administrative or procedural deadline.
  • Understand that the consultation does not include legal representation in court or any subsequent legal action.
  • Undertake to provide truthful and sufficient information.

CONDITIONS GÉNÉRALES DU SERVICE D’ORIENTATION JURIDIQUE PRO BONO DESTINÉ AUX PERSONNES SINISTRÉES

1. Objet du service

L’Ilustre Colegio de la Abogacía de Almería —le Barreau d’Almería— met à la disposition des personnes sinistrées par les incendies de Los Gallardos, Bédar et Antas un service d’orientation juridique initiale, assuré gratuitement par des avocats inscrits volontairement au dispositif pro bono créé à cette fin.

Le service a pour objet de fournir une première évaluation juridique des demandes directement liées aux dommages ou aux conséquences résultant des incendies.

2. Personnes bénéficiaires

Le service peut être demandé par les personnes physiques ayant été directement touchées par les incendies précités.

3. Contenu de la consultation gratuite

Le service comprend une première consultation juridique gratuite, au cours de laquelle l’avocat désigné pourra :

  • Informer la personne concernée de ses droits, des démarches possibles et des voies de réclamation disponibles.
  • L’informer, le cas échéant, de la possibilité de demander l’aide juridictionnelle.

4. Gratuité du service et absence d’engagement ultérieur

La consultation initiale sera entièrement gratuite pour la personne qui en fait la demande.

L’avocat désigné ne pourra exiger aucun honoraire, aucune contrepartie ni aucun paiement au titre de l’assistance fournie dans le cadre de ce programme. Il ne pourra pas non plus utiliser ce service pour démarcher ou orienter des clients.

5. Confidentialité et secret professionnel

Les informations, documents et communications portés à la connaissance de l’avocat au cours de la consultation seront protégés par les obligations de confidentialité et de secret professionnel.

Le secret professionnel couvre les faits, communications, données, documents et propositions connus ou reçus dans le cadre de l’exercice professionnel. Il demeure applicable après la fin de l’assistance.

6. Protection des données à caractère personnel

Responsable du traitement : ILUSTRE COLEGIO DE LA ABOGACÍA DE ALMERÍA — Q0463001H — dpd@icaalmeria.com.

Finalités : traiter la demande, vérifier le respect des conditions requises, désigner un avocat, organiser la consultation, assurer le suivi administratif du service et traiter les éventuels incidents ou réclamations.

Base juridique : le consentement de la personne qui présente la demande et la mise en œuvre des mesures nécessaires pour fournir le service expressément demandé.

Les données strictement nécessaires seront communiquées à l’avocat désigné. Elles pourront également être communiquées à des prestataires technologiques agissant pour le compte du responsable du traitement ainsi que, lorsqu’une obligation légale l’exige, aux autorités ou organismes compétents.

Lorsque la demande comporte des catégories particulières de données personnelles —par exemple, des informations médicales, des données relatives à un handicap ou d’autres circonstances personnelles sensibles— le consentement explicite de la personne concernée sera demandé lorsque cela sera nécessaire.

Les données seront conservées pendant la durée nécessaire à la gestion de la consultation puis pendant les délais requis pour répondre à d’éventuelles responsabilités légales ou déontologiques.

La personne concernée peut exercer ses droits d’accès, de rectification, d’effacement, d’opposition, de limitation du traitement et de portabilité en écrivant à dpd@icaalmeria.com. Elle peut également introduire une réclamation auprès de l’Agence espagnole de protection des données.

Ces informations devront être fournies de manière claire avant la collecte des données personnelles, conformément au Règlement général sur la protection des données et à la loi organique espagnole 3/2018.

7. Acceptation

En présentant sa demande, la personne concernée déclare :

  • Avoir lu et compris les présentes conditions générales.
  • Demander volontairement la consultation juridique initiale gratuite.
  • Autoriser la communication de ses données à l’avocat qui lui sera désigné.
  • Savoir que la présentation de la demande ne suspend ni n’interrompt aucun délai.
  • Comprendre que la consultation ne comprend ni la représentation en justice ni la réalisation de démarches ultérieures.
  • S’engager à fournir des informations exactes et suffisantes.

BEDINGUNGEN DES PRO-BONO-DIENSTES ZUR JURISTISCHEN ERSTORIENTIERUNG FÜR BETROFFENE PERSONEN

1. Gegenstand des Dienstes

Das Ilustre Colegio de la Abogacía de Almería —die Rechtsanwaltskammer von Almería— stellt den von den Bränden in Los Gallardos, Bédar und Antas betroffenen Personen einen juristischen Erstorientierungsdienst zur Verfügung. Dieser wird kostenlos von Rechtsanwältinnen und Rechtsanwälten erbracht, die sich freiwillig für den zu diesem Zweck eingerichteten Pro-bono-Dienst angemeldet haben.

Ziel des Dienstes ist eine erste rechtliche Einschätzung von Anfragen, die unmittelbar mit den durch die Brände verursachten Schäden oder Folgen zusammenhängen.

2. Anspruchsberechtigte Personen

Der Dienst kann von natürlichen Personen beantragt werden, die unmittelbar von den genannten Bränden betroffen sind.

3. Umfang der kostenlosen Beratung

Der Dienst umfasst eine kostenlose juristische Erstberatung, bei der die zugewiesene Rechtsanwältin oder der zugewiesene Rechtsanwalt:

  • Über bestehende Rechte, mögliche Maßnahmen und verfügbare Beschwerde- oder Entschädigungswege informieren kann.
  • Gegebenenfalls über die Möglichkeit informieren kann, staatliche kostenlose Rechtshilfe zu beantragen.

4. Kostenfreiheit und kein anschließendes Mandatsverhältnis

Die Erstberatung ist für die antragstellende Person vollständig kostenlos.

Die zugewiesene Rechtsanwältin oder der zugewiesene Rechtsanwalt darf für die im Rahmen dieses Programms erbrachte Beratung weder Gebühren noch sonstige Gegenleistungen oder Zahlungen verlangen. Der Dienst darf auch nicht zur Mandantenwerbung oder zur Vermittlung von Mandanten genutzt werden.

5. Vertraulichkeit und anwaltliche Verschwiegenheitspflicht

Sämtliche Informationen, Unterlagen und Mitteilungen, die der Rechtsanwältin oder dem Rechtsanwalt im Rahmen der Beratung bekannt werden, unterliegen der Vertraulichkeit und der anwaltlichen Verschwiegenheitspflicht.

Die Verschwiegenheitspflicht umfasst alle Tatsachen, Mitteilungen, Daten, Dokumente und Vorschläge, die im Rahmen der beruflichen Tätigkeit bekannt oder entgegengenommen werden. Sie besteht auch nach Abschluss der Beratung fort.

6. Schutz personenbezogener Daten

Verantwortlicher für die Datenverarbeitung: ILUSTRE COLEGIO DE LA ABOGACÍA DE ALMERÍA — Q0463001H — dpd@icaalmeria.com.

Zwecke der Verarbeitung: Bearbeitung des Antrags, Prüfung der Voraussetzungen, Zuweisung einer Rechtsanwältin oder eines Rechtsanwalts, Vereinbarung des Beratungstermins, administrative Betreuung des Dienstes sowie Bearbeitung möglicher Vorfälle oder Beschwerden.

Rechtsgrundlage: die Einwilligung der antragstellenden Person und die Durchführung der Maßnahmen, die erforderlich sind, um den ausdrücklich beantragten Dienst zu erbringen.

Die unbedingt erforderlichen Daten werden der zugewiesenen Rechtsanwältin oder dem zugewiesenen Rechtsanwalt mitgeteilt. Sie können außerdem an technische Dienstleister weitergegeben werden, die im Auftrag des Verantwortlichen tätig sind, sowie bei Bestehen einer gesetzlichen Verpflichtung an die zuständigen Behörden oder Stellen.

Enthält die Anfrage besondere Kategorien personenbezogener Daten —beispielsweise medizinische Informationen, Angaben zu einer Behinderung oder andere sensible persönliche Umstände—, wird, soweit erforderlich, eine ausdrückliche Einwilligung in deren Verarbeitung eingeholt.

Die Daten werden so lange gespeichert, wie dies zur Bearbeitung der Beratung erforderlich ist, und anschließend während der Zeiträume, die zur Klärung möglicher rechtlicher oder berufsrechtlicher Verantwortlichkeiten notwendig sind.

Die betroffene Person kann ihre Rechte auf Auskunft, Berichtigung, Löschung, Widerspruch, Einschränkung der Verarbeitung und Datenübertragbarkeit ausüben, indem sie sich an dpd@icaalmeria.com wendet. Sie kann außerdem eine Beschwerde bei der spanischen Datenschutzbehörde einreichen.

Diese Informationen müssen vor der Erhebung personenbezogener Daten in klarer Form bereitgestellt werden. Es gelten die Datenschutz-Grundverordnung und das spanische Organgesetz 3/2018.

7. Zustimmung

Mit Einreichung des Antrags erklärt die betroffene Person:

  • Diese Bedingungen gelesen und verstanden zu haben.
  • Die kostenlose juristische Erstberatung freiwillig zu beantragen.
  • Der Weitergabe ihrer Daten an die ihr zugewiesene Rechtsanwältin oder den ihr zugewiesenen Rechtsanwalt zuzustimmen.
  • Zu wissen, dass die Einreichung des Antrags keine Frist hemmt oder unterbricht.
  • Zu verstehen, dass die Beratung weder eine gerichtliche Vertretung noch die Durchführung späterer rechtlicher Maßnahmen umfasst.
  • Sich zur Bereitstellung wahrheitsgemäßer und ausreichender Informationen zu verpflichten.
